Detectives in Kongowea, Mombasa County, have arrested a man alongside his girlfriend in connection with the offence of sharing intimate photos of his ex-girlfriend on social media.

Mombasa County police commander Peter Kimani said that the duo, namely Jackson Wamalwa, aged 25 years, alongside his current girlfriend, Michelle Luyeku, 23, were arrested on Saturday after investigations revealed that Wamalwa had shared obscene videos of his ex-girlfriend with Luyeku, who shared the intimate images without the victim’s consent on her social media platforms.

The police boss stated that sharing the intimate images without the consent of the victim was an offence under the Computer Misuse and Cyber Crimes Act (CMCA) of 2018.

“The two are in police custody awaiting arraignment before a court of law, since section 37 of the Act criminalises the wrongful distribution of the obscene intimate images the suspects shared through social media,” he stated.

The arrest follows Principal Secretary for Internal Security and National Administration Raymond Omollo’s plea to lawmakers to strengthen cybercrime laws amid rising digital threats.

He additionally warned young people against misusing mobile phones and social media to spoil their lives, as such acts amount to criminal offences which are punishable by law.

“Let the youths be warned of misusing their mobile phones, since such acts are punishable by law,” said Kimani.

He further called on parents to educate their children on the dangers of the misuse of social media.

“Let the relevant bodies, among them the media and civil societies, sensitise the community on the risks of technology-facilitated gender-based violence (TFGBV), which has contributed to the loss of many lives through acts of sharing obscene images or serving long jail terms,” he stated.

According to police, the suspects will be charged with threatening to kill his ex-girlfriend, cyber harassment, violation of privacy and sexual harassment.
