Drama as Ndegwa Njiru brings his client to court in an ambulance to answer show cause
By Zipporah Ngwatu, November 5, 2025Drama and disagreement ensued at the Milimani High Court after lawyer Ndegwa Njiru presented his client, Ashwin Shah, for a show cause as ordered by the court.
The court was informed on Tuesday, November 4, 2025, that the plaintiff in the matter (Ashwin) was within the court premises but was unable to get into the courtroom because he was in an ambulance.
Lady Justice Njoki Mwangi, who is the presiding judge in the matter, asked why he had been brought in an ambulance, adding that the act was dramatic.
She further questioned why she was not informed that the plaintiff was to be brought to court in an ambulance.
“Why was I not told that the plaintiff would be brought in an ambulance? Is this not drama you are causing?” Judge Njoki asked lawyer Njiru.
In his defence, lawyer Njiru said that he tried to address the court on the current state of his client, but he was muted as he was trying to explain.
“My lady, when we appeared before you yesterday (Monday, November 3, 2025), I attempted to address you on the immobility of the plaintiff, but then I was muted by the court. In the morning, when I appeared and requested for this time, I again indicated to the court we shall bring the plaintiff in the condition in which he is,” lawyer Njiru told the court.
However, Judge Njoki maintained that lawyer Njiru did not indicate to the court the condition his client was in.
Judge Njoki revealed that on October 4, 2024, she ordered the plaintiff and an auctioneer to attend court for notice to show cause.
Audience with court
In October 2025, the judge said that she categorically stated that she will not give the plaintiff further audience until he comes to court.
“The ruling in which I made orders that the plaintiff and the auctioneer were to attend court for notice to show cause was delivered on October 4, 2024,” Judge Njoki stated.
Further, she states that since then the plaintiff has been avoiding court proceedings by failing to attend court, adding that he chose to come to court on his own time after a warrant of arrest was issued against him.
The court states that it directed that he attend court, and instead of doing so, Mr Ndegwa attended virtual court and started to address the court on the application that their client had filed.
“It must not be forgotten that on October 14, 2025, I was categorical that I will give no further audience to the plaintiff until he either surrenders in court in answer to the notice to show cause as to why he should not be punished for contempt of court or he is to be brought to court under the warrants of arrest issued,” Judge Njoki stated.
“In my ruling of October 3, 2025, I declined to set aside or lift the warrant of arrest issued against the plaintiff on November 22, 2024,” the judge added.
The court noted that since the plaintiff has been brought to court to answer to the show cause in an ambulance, he is certainly not in a position to answer to the said notice to show cause.
It was also revealed that the plaintiff’s legal team had indicated that he suffers from dementia, prompting the judge to question his ailment since he has been issuing instructions to his legal team and swearing affidavits.
“It has been purported time and again that the plaintiff is sick and allegedly suffering from dementia, but he has numerous times filed applications and supportive affidavits which clearly indicate that he does not suffer from dementia; otherwise, how would a man suffering from dementia give instructions to his advocates to file documents and even swear affidavits to support them?” Judge Njoki stated.
Judge Njoki has ordered the Parklands Police Station officers to produce the plaintiff before court after he recovers from the ailment he is suffering from.
“Since notice to show cause can not be done on a litigant who is in an ambulance, the police from Parklands Police Station will produce him in court on any working day from Monday to Friday, 9am to 5pm, after the plaintiff, Aswin Shah, recovers from whatever ailment he is suffering from.
