A Nairobi court has acquitted former Bahati producer who was charged with obtaining over Sh2 million from the musician, ruling that the case is an abuse of court process.
Nairobi Principal Magistrate Bernard Ochoi acquitted Peter Mwanyalo alias Peter Blessings, who was charged last year, ruled that the case is civil in nature and cannot be tried as a criminal suit.
Blessing was charged that on July 4, 2019 and January 5, 2020 at EMB records studios in Nairobi, obtained Sh2 million from producer Kevin Kioko alias Bahati by pretending that he was able to produce music videos for the musician.
He pleaded not guilty before Nairobi Chief Magistrate Martha Mutuku.
The accused person allegedly joined EMB entertainment in July 2017 and was given Sh2,039,000 on diverse dates in order to continue producing music with the said company.
In court, the prosecution claimed that Blessings did not deliver but allegedly disappeared with the cash.
“I find that a prima facie case has not been established by the prosecution and I hereby acquit the accused on all the counts,” ruled Ochoi.
The magistrate further said that the the investigating officer in the matter did not conduct thorough investigations to ascertain whether the matter is civil in nature or criminal.
