Treasury Cabinet Secretary Henry Rotich and his Principal Secretary (PS) Kamau Thugge will spend Tuesday night behind bars after failing to post their bonds.

The duo were ordered to pay Sh50 million bond or Sh15 million cash bail to secure their freedom after denying all charges against them in the Kimwarer and Arror dams case.

They were charged on Tuesday alongside East Africa Community Principal Secretary (PS) Susan Jemtai Koech, Chief Economist and Head of Europe 11 Division Kennedy Nyakundi Nyachiro, NEMA Director Geoffrey Wahungu and 11 tender committee members.

The embattled CS conspired with his PS and nine others to defraud the government of Kenya over Sh24 billion in the development of Kimwarer multipurpose dam.

Mr Rotich allegedly entered into a loan facility agreement disguising it as a government-to-government loan guaranteed by the Italian government knowing all along that the tender document contained in the request proposals for the dam project was concessional agreement.

“The Kimwarer multi-purpose dam project was a concessional agreement where the intended concessionaire was to be the borrower and financier and not the government of Kenya,” read the charge sheet.

The suspects appeared before Nairobi Chief Magistrate Douglas Ogoti.
