Magistrate tells lawyers in Waititu case to iron out their issues on WhatsApp

An Anti-Corruption chief magistrate has advised lawyers in Governor Ferdinand waititu matter to form a WhatsApp group to discuss issues related to the case before the matter comes up for pre-trial.

“Counsels, let me advise you consider new technology and form a platform to discuss issues and exchange court documents to make work easier,” said Chief Magistrate Lawrence Mugambi. 

This was during a mention of a case where Governor, his wife Susan Ndung’u, and other county officials are charged with Sh588 million fraud.

Monday’s mention was to confirm if the state has supplied all evidence documents in relation to the case.

Meanwhile, nine Kiambu Members of County Assembly (MCAs) want to be enjoined as interested parties in the case against the governor.

The 9 MCAs have instructed a lawyer to have them enjoined in the case.

But the defense team objected to the application saying that the MCA’s have no locus standi. 

“Let them make a substantive application …let’s not turn this into a political case,” defense argued

Mr Mugambi directed the MCAs to file a formal application and their intention to participate the case. 

During Monday’s mention, the prosecution said that it has supplied the defense with all witness statements although some of the suspects said they are yet to be supplied with the said documents

The court has fixed the pre-trial for September 27.
