A man accused of assaulting his 23-yr-old girlfriend causing her actual bodily harm has walked scot-free after the woman filed a notice to withdraw the suit.

Robert Ouko Bonyo is alleged to have assaulted his girlfriend who has a month-old baby on May 16, 2020, at their posh home in Riverside, Nairobi, according to their lawyer Abdul Angoga.

The couple’s lawyer, Abdul Angoga, said the man allegedly assaulted her after arriving home in the wee hours of the night.

The suspect after realizing he had hurt his girlfriend took her to hospital where she was treated. She later reported the matter to the Kilimani Police Station and the boyfriend was subsequently arrested.

Ruth Cherubet told Nairobi Senior Resident Magistrate Caroline Muthoni that Robert was contrite and profusely apologetic and that after a further talk the following day, she realized it was a mistake and she wanted to forgive him.

In the affidavit she filed in court, Ruth said that she called the boyfriend on May 20, 2020, to pick her up from her sister’s house so that they can resume their normal life and raise their child together.

The woman, in the affidavit, said that the was not in any way coerced to withdraw the suit against her child’s father with whom she insists they intend to get married.

In fact, Ruth stated that Robert revealed to her that the court on May 17, 2020, had directed him to not contact her physically, an order he complied with.

The man, who was out on a cash bail of Sh50,000 lived at his friend’s house for 10 days after allowing Ruth to stay at their Riverside home with their baby.

The magistrate marked the case closed on account of Ruth’s affidavit.
