Lawyer Miguna Miguna now claims former Migori Governor Okoth Obado, who is facing murder charges over the death of Sharon Otieno, is innocent.
Miguna on Wednesday, October 12, alleged that Obado’s case was politically instigated and urged the Directorate of Public Prosecutions (DPP) to drop the murder charges against the former county boss.
Miguna was reacting to the DPP’s move to withdraw graft charges against former Samburu Governor Moses Lenolkulal and ex-Malindi Member of Parliament Aisha Jumwa, who claim they were victims of political extremism.
Jumwa, who was facing charges of conspiring to commit fraud by illegally paying Ksh19 million, had her charges withdrawn under section 87 (a) of the Criminal Procedure Code (CPC).
The prosecution through Senior state counsel Alex Akula informed Mombasa Chief Magistrate Martha Mutuku that he was under instructions to apply for withdrawal of charges for the first accused person.
Miguna on Wednesday night suggested that Obado, who is said to have been in a romantic relationship with the deceased, is next.
“Cases must never be initiated against innocent Kenyans in order to create work for the EACC, DCI
and Judiciary. Kenyans should only be charged if there is credible evidence that they have committed crimes and the evidence is sufficient to convict them,” Miguna responded to a tweep who said the DPP’s move will leave investigative agencies with ‘no work’.
“Okoth Obado is next. Impregnating a woman is not a crime. There is zero evidence that Okoth Obado murdered Sharon Otieno. I said zero. Okoth Obado was charged to stop him from campaigning against Ochillo Ayako,” he added.

Obado case
The former Migori governor, his personal assistant Michael Juma Oyamo and County Clerk Caspal Obiero are charged with the murder of Sharon and her unborn baby.
The 24-year-old, who attended Rongo University, was found murdered in a thicket in September 2018 after being abducted by unknown persons.
She was at the time seven months pregnant. An autopsy report revealed that Sharon’s killers stabbed her eight times killing her and the foetus.
The accused persons denied the murder charges and are out on bail.
