Leaders elected in August given 30 days to declare their wealth

The Ethics and Anti-corruption Commission (EACC) has given elected leaders and government officials 30 days to declare their wealth.

In a circular dated September 2, 2022, EACC said that the declaration will involve spouses and dependant children under the age of 18

“Commission has commenced enforcement of the requirement for all persons elected, nominated or appointed to public office, and all those exiting Government following the 9th August 2022 General Election to declare their wealth, and that of their spouse(s) and dependent children under 18 years, within 30 days,” a representative from EACC told K24 Digital.

The declaration is in line with Sections 26 and 27 of the Public Officer Ethics Act, 2003, which require every public officer to submit an initial declaration of income, assets, and liabilities of him/herself, spouse(s), and dependent children under the age of 18 years, within 30 days of joining public service, once every two years thereafter, and a final declaration within 30 days of exiting public service.

Wealth declaration forms

“Following the General Election held in Kenya on 9th August 2022, the Commission, in the exercise of its oversight and enforcement powers, hereby notifies all persons joining or exiting the public service to make their initial or final declarations, as the case may be. The duly filled declaration forms should be submitted to the entities specified or envisaged under Section 3 of the Act,” the circular read in part.

“The Accounting Officer shall prepare and submit to EACC a report on the status of compliance, including a list of officers who have complied and those in breach. The report should reach our offices not later than 30th October 2022.”

The declaration forms will be submitted to respective service commissions/boards or entities that deal directly with the officials.
