Lawyer files motion to oust LSK boss Eric Theuri

City lawyer Lempaa Suyinka has filed a motion seeking the removal of Law Society of Kenya (LSK) President Eric Theuri.

The lawyer accuses Theuri of being complacent and abetting the violation of the rule of law by failing to oppose the termination of Ksh15 billion criminal cases against top government officials.

Lempaa is seeking to remove Theuri for failing to join a petition blocking the appointment of Noordin Haji as the Director General of the National Intelligence Service (NIS).

Lempaa accuses Theuri of being compromised by the State House when they accompanied Haji in a meeting with the President.

“Theuri and the entire council of LSK were summoned by Haji and taken to State House where they abandoned their quest for an explanation of the withdrawal of the criminal cases against high-profile government executive officers, parastatal chiefs and businessmen traders,” Lempaa says.

The aggrieved lawyer says that in section 4 of the Law Society of Kenya Act number 21 of 2014 the functions of the law body are well spelt out which includes assisting the court in matters relating to legislation and administration of justice. He adds LSK champions the upholding of the constitution of Kenya and advancing the rule of law.

Lempaa vs Theuri

Lempaa faults the LSK President for failing to join a petition filed in court by activist Katherine Cherotich against Haji and five others seeking to restrain him from being considered for the post of NIS boss.

The lawyer is urging the members of LSK to impeach Theuri during a special general meeting to be held on July 11, 2023, in Nairobi county at 11 am. He also wants the LSK members to resolve that the body participates in the lawsuit filed by Cherotich.

Lempaa claims that Theuri declined to enter an appearance on behalf of LSK even after a resolution had been passed to join the Cherotich case against Haji

Lempaa accuses the LSK President of keeping quiet when Haji withdrew under mystery circumstances the Ksh7.3 billion case against Deputy President Rigathi Gachagua, the Ksh2 billion corruption case against Communications Authority chairperson Mary Wambui and the putting on hold of extradition of former finance minister Chris Okemo and former KPLC boss Samuel Gichuru.

Other cases quoted by Lempaa are those against former Nairobi Governor Mike Sonko, former KPLC boss Ben Chumo, and Cabinet Secretary for Public Service Aisha Jumwa among others.
