Public Service and Gender Cabinet Secretary Aisha Jumwa is expected to know the fate of her murder case on Wednesday, November 30, 2022, weeks after applying for withdrawal of the charges against her.
The case is scheduled for mention at the Mombasa Law Courts, where the Directorate of Public Prosecutions is expected to declare its stand on Jumwa’s bid to have charges against her withdrawn.
Early this month, Jumwa asked DPP Noordin Haji to drop the murder charges, arguing that the evidence the prosecution presented in court does not meet the threshold to hold the case.
However, in the latest development, Jumwas lawyers, led by senior counsel Jared Magolo and Titus Kirui, revealed that the DPP is yet to officially reply to Jumwas application that sought to have the matter settled outside court.
Kirui said the defence team was yet to receive official communication from the state on how to proceed with the application.
Jumwa murder case
Jumwa and her aide Geoffrey Okuto are accused of killing 48-year-old Ngumbao Jola on October 15, 2021, when chaos broke out during the Ganda by-election.
In Jumwa’s letter to the DPP, the CS requested to be turned into a state witness since she was not a principal suspect in the case.
She pleaded for an out-of-court settlement to pave way for compensation to the family of the deceased.
Last month, Haji, through state counsel Vivian Kambuga, informed High Court Judge Anne Onginjo that she had not received the withdrawal notice on the matter, since her office was yet to receive specific, crucial details from the defence team on the outside court settlement with the deceased family.
Onginjo ordered Jumwa to surrender her passport to the court ahead of the mention of the case tomorrow.
