High Court disqualifies ANC aspirant for holding three citizenships

Fafi parliamentary candidate Mohamed Subey Gedi (ANC) on Wednesday, July 27, 2022 suffered a major blow after the High Court disqualified him from participating in the August polls.

Lady Justice Abida Aroni declared Gedi’s clearance by the Independent Electoral and Boundaries Commission as unconstitutional, null and void since he holds three citizenships.

Gedi who was cleared to vie for Fafi constituency in Garissa county is said to be a citizen of three countries namely America, Kenya and Somalia.

While nullifying Gedi’s candidature, the court noted that under Article 78(1) of the Constitution, a person is not eligible for election to a state office unless the person is a citizen of Kenya.

“I hereby hold that the first respondent (Gedi) is not qualified to run for the position of Member of Parliament for Fafi Constituency,” Justice Aroni ruled

She however ordered the IEBC to withdraw the clearance certificate issued to Gedi immediately.

Gedi was cleared to vie for the seat under ANC in the forthcoming elections and was to face his competitors namely; UDA Fafi Salah Yakub (UDA), Abdikain Osman (Jubilee) and Mohamed Diis Shafat (Kanu).
