Kabogo risks being committed to six months in civil jail for contempt of court

Former Kiambu governor William Kabogo risks being committed to civil jail for a term of 6 months for contempt of court.

This is after Joseph Matano, an applicant sought for a summon to be issued against the former governor, to appear before the Mombasa law courts to give reasons why he should not be committed to civil jail.

“Your presence will be dispensed with the sum of 3.4 million being the balance, the amount for a decree with an interest cost of execution and court collection fees are lodged in court before the said read, and further to show cause on why the judgment debtor should not be committed to civil jail for six months” part of the court order reads in parts.

The latest comes after Kabogo defied court orders to pay the applicant general and special damages amounting to Ksh3.4 million.

This was after the applicant sustained injuries that led to permanent disability when he was hit by a vehicle belonging to Kabogo in 2012.

In a judgment delivered by the then Mombasa chief magistrate Julius Nangea in 2016, the court observed that the plaintiff deserved to be compensated for the loss of his earnings following the accident that made him become dependent on others.

“The plaintiff in the premises sets a total of Ksh3.4 million being both general and special damages is accordingly entered in his favour, he is also granted the costs of the suit and interest at the court rates, “Nangea ruled.

Matano had sued Kabogo after one of his vehicles caused an accident that left his right leg amputated. He informed the court that the injuries resulted in 65 per cent permanent disability making it difficult for him to enjoy his conjugal rights

The court ordered Kabogo to appear on October 26
