Court allows CS Linturi to evict MP Marianne Kitany from Runda home

A Nairobi court has ordered Runda Police station OCS to provide security and assistance to the auctioneers set to evict Aldai Member of Parliament Marianne Kitany from a contested home.

“The OCS Runda police station Nairobi or any other officer from the station of the rank above assistant inspector of police be and hereby ordered to provide security and police assistance in evicting Maryanne Kitany from House No. 16 Ridge County Villas in Runda Estate,” the magistrate ruled.

The Magistrate issued the orders after Kitany failed to stop Linturi from evicting her from the palatial home.

On September 27 last year, chief magistrate Heston Nyaga ruled that Linturi and Kitany were never married.

The Magistrate court had declined to recognize her marriage to Linturi saying the same was a nullity and that it could neither be presumed as marriage under the laws of Kenya.

Kitany moved to the high court seeking to suspend the said Judgement but Justice Maureen Odero declined to issue the said order.

Kitany wanted the High Court to issue an injunction against Linturi restraining him from evicting her from the said residence but the Judge ruled that she had no jurisdiction to entertain the suit.

Justice Odero had noted that Kitany had filed other similar applications at the Court of Appeal which was dismissed.
