We couldn’t pick your calls – DCJ Mwilu tells lawyers after Supreme Court upheld Ruto’s win

Deputy Chief Justice Philomena Mwilu has revealed that a number of lawyers tried to call the seven Supreme Court Judges while they were writing the judgment of the 2022 consolidated Presidential election petition.

Speaking moments after the appex court delivered its judgement, Mwilu said that they could not pick the calls, in a bid to deliver an impartial judgment.

“We, the seven of us, have not slept since we parted company on Friday. I think it is showing on our faces. We work under difficult circumstances especially because of time. As ground rules, we agreed when we left you here on Friday that we would not pick any of your calls. A lot of you called us, but we just couldn’t pick your calls and I hope you understand that we couldn’t,” Mwilu said.

On Monday, the Supreme Court unanimously upheld the election William Ruto as the fifth President of Kenya to succeed President Uhuru Kenyatta.

“We declare the election of the first respondent as President-elect to be valid,” Chief Justice Martha Koome ruled.

In the elections held on August 9, 2022, the Independent Electoral and Boundaries Commission (IEBC) chairman Wafula Chebukati declared William Ruto the winner after garnering 7,176,141 votes (50.49 per cent) of the total votes cast.

Azimio la Umoja-One Kenya Alliance’s Raila Odingagot 6,942,930 votes representing 48 per cent of the votes cast.
