NYS scandal: Court extends order barring Ksh6.1B payout to suppliers

A Nairobi High Court has extended conservatory orders issued barring the payment of Ksh 6.1 billion to suppliers at the National Youth Service (NYS).

The High Court had issued interim orders on December 8, 2025, halting the payments to the companies linked with businessman Ben Gethi, Wangui, and 14 others.

The Ethics and Anti-Corruption Commission (EACC) moved to court seeking a declaration that 277 payment vouchers amounting to Ksh 6.1 billion belonging to NYS were fraudulent.

Further, EACC sought orders halting the payment of the said vouchers and damages against public officers for breach of fiduciary duty and misfeasance in public office.

Appearing before Milimani Anti-Corruption Judge Benjamin Musyoki on Monday, February 2, 2026, EACC sought to have the conservatory orders extended pending the hearing of their case.

Notably, EACC asked the court to hear three applications by EACC, Gethi, and the 5th and 6th defendants together and also order that they be disposed of by way of written submissions.

Judge Musyoki granted the EACC’s prayers and extended the orders until March 23, 2026.

He also directed the defendants (Ben Gethi and others) to respond to the EACC application within seven days and file a further affidavit and submissions in respect of all applications within 14 days of service.

The court also ordered Gethi and 14 others to file their submissions within 14 days upon receipt of the EACC submissions.

“The interim orders issued on December 8, 2025, are extended until March 23, 2026, and the matter is scheduled for mention to confirm compliance on the same date,” Judge Musyoki directed.

“The three applications shall be heard together and shall be disposed of by way of written submissions,” Justice Musyoki added.

The court also heard that NYS, listed as an interested party in the suit, had complied with the order issued by Justice Muteti on December 24, 2025, by returning the payment vouchers to the Commission on January 15, 2026.

The EACC also said that they responded to the application made by the defendants (Gethi and others) dated December 15, 2025, through a replying affidavit sworn on January 30, 2026.
