Lugari MP Nabii sues bloggers over links with Munyuki High School principal murder, demands Ksh60M

The Lugari Member of Parliament (MP) Nabii Nabwera has sued three bloggers over defamatory statements against him that were published through online platforms linking him with the death of Munyuki High School principal the late Simon Isiaho Shange.

Through a certificate of urgency filed in court, the legislator avers that bloggers Opunga Tamata, Simon Asievela and Peter Amunga published false and inaccurate information on their platforms, adding that the publications are injurious to his reputation in the constituency and the country.

MP Nabii, through his legal team led by Danstan Omari and Martina Swiga, now wants the Milimani Commercial Magistrate Court to compel the three to pay him Ksh20 million each for the damage to his reputation caused by the said publications linking him with the death of the deceased.

“That pending the hearing and determination of this application and suit, this honourable court be and is hereby pleased to order that the respondents (Opunga, Asievela and Amunga) compensate the applicant (Nabii) a sum of twenty million Kenyan shillings, being the damage caused to his otherwise stellar name and reputation,” part of the prayers sought read.

Further, Nabii is also seeking to have the court issue an order for the three bloggers to pull down, erase and delete any and all false, acrimonious and defamatory publications they have made and published against him.

Apology

In a notice of motion, the MP also wants the court to order the bloggers to tender an apology to him for what he states are malicious, false and unqualified publications made, published and posted against him.

He also wants the court to bar the three and anyone working under them from continuing to publish the said defamatory posts on social media platforms until his application is heard and determined.

“That pending the hearing and determination of this application, this court be pleased to bar the respondents (Opunga, Asievela and Amunga), their agents or any other person working under their instructions from posting, making or in any other way publishing defamatory statements against the applicant (Nabii),” part of the notice of motion read.

Senior Principal Magistrate Lucy Njora has certified the matter urgent and ordered the three bloggers to be served with the application.

The court has ordered the three to apologise to MP Nabii for the malicious, false and unqualified publications made, published and posted against him.

“The matter is certified as urgent, and prayer three is granted,” Magistrate Njora ordered.
