DPP opposes bond application for man accused of killing 4 Eastleigh women

Lady Justice Muigai on Tuesday, February 11, 2025, ordered Hashim Dagane Muhumed alias Hashim Mohamed Khalif accused of murdering four women to remain in Nairobi remand till March 4, 2025.

Muhumed is accused of killing the women in two counties; Machakos and Nairobi in October 2024.

Delivering the order, Justice Muigai said this is to give time for his pre-bail report to be prepared.

According to the affidavit filed by the Directorate of Criminal Investigations Officer (DCIO) Mohamed Hassan to oppose the bond, the accused is said to have a duo citizenship (Somali and Kenya) with his Somali passport and Kenyan Identification Card (ID) bearing different names.

On June 15, 2023, the accused is said to have applied for an ID at the Ministry of Interior and National Administration in Kenya which was under the name Hashim Dagane Muhumed, while his Somali passport was issued on February 21, 2022, bearing the name Hashim Mohamed Khalif.

Further, the affidavit states that the accused is a flight risk.

“The accused having roots in both Kenya and Somalia, we are apprehensive that he is likely to be a flight risk considering that there is a porous border between the two countries,” part of the DPP affidavit read.

The affidavit also states that Hashim did his primary and secondary education in Ethiopia where his father Mohamed Khalif lives in State five Godey between 2006 and 2010.

Notably, between 2010- 2015 the accused is said to have been recruited to Yahedic Commandos (Ethiopian Army) before he left in unclear circumstances

Officer Hassan adds that there is a very high chance of the accused interfering with witnesses expected to testify on the case because they are well known to him including relatives and workmates to the four victims.

“We are apprehensive that there is a very likelihood of the accused interfering with prosecution witnesses given that he is well known to nearly all the civilian witnesses including the deceased’s husband, four workmates to deceased, the accused’s employer, taxi driver, and persons related to the 4 victims and workmates,” part of the affidavit red.a

On top of that, Hassan says that releasing the accused may trigger public outrage citing that there were demonstrations that took place in Eastleigh relating to the deceased in count 1-3 on October 24, 2024.

However, Hashim opposed the applicant’s affidavit to deny him bond urging the court to dismiss the affidavit stating that the prosecution has not satisfied the constitution threshold to establish compelling reasons militating against granting bail.

On January 21, 2025, before High Court Judge, Justice Kanyi Kimondo, through his lawyers Hashim sought to be granted lenient bail terms.

However, Justice Kimondo directed the Office of the Director of Public Prosecutions (ODPP) to serve the defence with an affidavit opposing the bail within one week, adding that the defence is free to reply to the DPP on the same.

“The DPP to serve the defense with the affidavit opposing bail within the next 7 days. The defense will be at liberty to reply to that affidavit before the next mention date on February 11, 2025,” Judge Kimondo directed.

Hashim accused of murder contrary to section 203 as read in section 204 of the Penal Code is said to have carried 3 of the 4 murders in one night one at Machakos County and two at Nairobi County.

In the first count, Hashim is said that on the night of October 21, 2024, and October 22, 2024, he killed 37-year-old Dahabo Daud Said Alias Waris at Kyumbi area within Machakos County.

In the second count, Hashim is accused that on the night of October 21, 2024, and October 22, 2024, at Parklands area within Nairobi County, he killed 22-year-old Amina Abdirashid Dhahir.

He is accused of killing 13-year-old Musayba Abdi Mohamed contrary to section 203 as read with section 204 of the Penal Code that on the night of October 21, 2024 and October 22, 2024 in Parklands area within Nairobi County, in the third count.

On the fourth count, the accused is said to have murdered 26-year-old Deka Abdi Noor Gorane, contrary to section 203 as read with section 204 of the Penal Code on the night of October 29, 2024, and October 30, 2024, at Valley Heights apartment in Nairobi.

Deka was said to have been involved in a romantic relationship with the accused since January 2024 and both had places of abode within Eastleigh estate.

Hashim was arrested early November, 2024, and was in police custody until December 24, 2024, when the High Court took over and remanded him at the Nairobi Area Remand and Allocation Prison awaiting to be formally charged after the ODPP informed the High Court of its intention to charge the suspect with murder contrary to section 203 as read with section 204.
