Matiang’i has not received any summons from DCI – lawyers

Former Cabinet Secretary for Interior Fred Matiang’i is yet to receive valid summons to appear before the Directorate of Criminal Investigations (DCI) for interrogation of the alleged police invasion of his Karen residence on the night of February 8 and 9, his lawyers now claim.

Clarifying media reports regarding the matter, Matiang’i’s lawyers Paul Machari, Shadrack Wambui and Danstan Omari on February 24 said their client has not been served personally with summons to appear before the detectives for questioning.

Reacting to an unsigned letter circulating on social media, the lawyers told the media that the order is usually served in person and signed by three police officers for it to be considered valid.

“As of now, Matiang’i had not been personally served as required under the law. He could not honour summons which to me is manufactured from river road, ” Lawyer Omari stated.

“The DCI misled the entire media fraternity and Kenyans into believing that he had issued valid summons to Matiang’i,” he added.

He claimed that the new DCI boss Amin Mohammed was acting in a clandestine manner, which leaves a lot to be desired.

The lawyers stated the newly appointed DCI boss is exhibiting smarks of incompetence and the legal fraternity would pursue a petition for his removal from office.

“The DCI is a creation of the law, appointed under the law and he (Amin) must act within the perimeter of the law. Short of that will file a petition for his removal,” the lawyers contended.

Omari, while clarifying the whereabouts of the former powerful CS, confirmed that Matiang’i is very much around as a private citizen going about his business peacefully.

“When he is wanted we will produce him. He is just a phone call away from us, ” Omari stated.

The lawyers also noted that the police can not arrest Matiang’i as he is currently out on an anticipatory bail of Ksh200,000.

This is after the Court on Thursday, February 23, 2023, extended the orders blocking police from arresting the former minister.
