Kabarnet woman narrates how ‘neighbour from hell’ beat her up, and her husband

A woman from Kabarnet narrated to a magistrate how her neighbour rained blows on her repeatedly, pelted her with a stone and even physically fought with her husband.

Lorna Kipkurui was testifying in a Kabarnet court on Wednesday against John Tilion, whom she accused of beating her up, not just once but three times.

Lorna told the court that Tilion boasted that he was rich and untouchable.

“Your honour this is the third time the accused has assaulted me while issuing threats,” Lorna told Kabarnet Senior Principal Magistrate Paul Biwott.

Lorna was testifying the case in which Tilion has been charged with causing her bodily harm on August 9, 2019, at Lake Base Estate in Lake Baringo, Marigat Sub-County.

On the said incident, Lorna told the court that she had just finished preparing supper for her family at about 9pm when she heard her husband quarreling with the accused outside their house.

Lorna said she came out of the house and asked her husband what had happened, and he informed her that he was talking on phone when Tilion approached himfrom nowhere, demanding to know why he was selling his shamba (farm) over the phone.

She said she that pleaded with the husband to leave Tilion alone, a request he complied to leaving the accused outside still hurling insults at him.

While inside the house, the complainant said, she peeped through the window and immediately the accused picked a stone and hit her on the ribs. She fell to the floor and lost consciousness.

When she came to, Lorna told the court that she found her husband and Tilion on the ground fighting each other and that’s when she called for help from her neighbours.

“Your honour, the accused had formed a habit of assaulting people, claiming to be super rich and without fear of the police claiming ‘nobody can take me anywhere’,” she said.

 Lorna said their neighbours did not heed to her call for help so she ran to the Marigat Police Station where she reported the assault.

After recording a statement with the police, Lorna said she went to the Baringo County Referral Hospital, Kabarnet, and had an X-ray conducted to facilitate issuance of a P-3 form, which is used in court as evidence.

When the magistrate asked Tilion if he had anything to say before adjourning the case, he asked the court to reduce his cash bail of Sh10, 000 or alternative personal bond of Sh20, 000 with one surety of similar amount, a request the court declined.

 The court adjourned the case until October 8, 2019, when hearing will resume, with more witnesses expected to be lined up.
