Azimio la Umoja – One Kenya coalition party now says the Independent Electoral and Boundaries Commission (IEBC) is yet to comply with the Supreme Court orders requiring the commission to open its servers to the petitioners for scrutiny.
A seven-judge bench led by Chief Justice Martha Koome on Tuesday, August 30, ordered IEBC to grant the petitioners supervised access to its servers used in transmitting presidential results at the National Tallying Centre.
But addressing the court on Wednesday, Azimio lead counsel James Orengo complained that there was no compliance in regards to the orders issued yesterday.
The Senior Counsel also noted that his team was having difficulties with the orders issued by the court, saying they had only been given restricted access to one server — the results transmission system.
According to Orengo, the petitioners had established that IEBC has eight servers.
“We are having difficulties with the orders relating to the inspection of the servers. We have been given restricted access only to the result transmission system. We can only access one server and it is established that the IEBC has got eight servers,” Orengo said.
“There is no compliance in terms of the orders the court gave,” he added.
He said Azimio has written to the Judiciary Registrar seeking clarification on the matter.
Justice Isaac Lenaonal confirmed that the court was aware of the issue and efforts are underway to address it.
IEBC ordered to open its servers
IEBC was ordered to grant the petitioners supervised access to any server used to capture images of Form 34C at the tallying centre in Bomas of Kenya.
“That IEBC be compelled to give the applicants supervised access to any server(s) at the National Tallying Centre for storing and transmitting voting information and which are forensically imaged to capture a copy of the Form 34C which is the total votes cast,” read court orders.
Azimio presidential flag bearer Raila Odinga and his running mate Martha Karua claim IEBC systems were infiltrated and results changed. The duo wants the declaration of William Ruto as President-elect by IEBC Chairperson Wafula Chebukati quashed.
