Two officers attached to Mathare Police station are set to be arraigned at Milimani Law Courts for allegedly assaulting and injuring a city lawyer.

Constables Benedict Mugo and Moses Labu Kengere are also said to have preferred false criminal charges of obstructing police officers and trespassing against the advocate.

The two were arrested by the Internal Affairs Unit officers on Thursday following recommendations by the Office of the Director of Public Prosecution (ODPP).

“They will be arraigned before Milimani Law Courts to face charges of Assault causing actual bodily harm Contrary to Section 251 of the Penal code and abuse of office contrary to section 101(1) as read with section 102(A) of the Penal Code,” a police report seen by K24 Digital reads in part.

Rogue cops

In recent years, some rogue officers have been accused of planting evidence and even filing trumped-up charges against members of the public.

The extent of the menace can, however, not be established as most victims, especially foreigners, suffer in silence and would opt to pay hefty bribes.

A good example is a case that happened last year, where officers from Ngerenya police station arrested and charged a Class 7 pupil with murder.

Investigations later revealed that it was a cover-up since the pupil had witnessed some police assaulting her friend.

The matter — Malindi High Court case CR E005 of 2020 — was terminated by the ODPP after intervention from the Internal Affairs Unit detectives on October 5 last year, 2021.
