Win for Sakaja as CUE backs down in degree saga

Nairobi gubernatorial candidate Johnson Sakaja can now breathe easy after the Commission for University Education (CUE) withdrew a letter revoking recognition of his degree certificate.

The move follows Sakaja’s petition accusing CUE Chairman Prof Chacha Nyaigoti-Chacha of disobeying court orders suspending revocation of his degree certificate from Team University in Uganda.

Sakaja, through lawyer Elias Mutuma, claims the CUE boss had shown contempt by addressing the media on 17th and 20th June 2022 regarding the authenticity of Sakaja’s degree certificate.

“On the even date, 17th June, 2022 at 7:00 p.m, the Contemnor herein one PROF. CHACHA NYAIGOTI-CHACHA who is the Chairman of the Board of the Respondent, went live on all major National Televisions and other media fora wherein he issued a press statement whose contents were a mockery and contemptuous of the Court’s orders earlier served upon the Respondent,” reads court documents.

“THAT later, on 20th June, 2022 at around 5:00 p.m. the Contemnor again released a signed press statement to all media houses , wherein he ostensibly made reference to the Applicant, the orders of status quo ante , and the court process in general.”

The Commission, in its response, said it had withdrawn the letter revoking Sakaja’s degree pending a further probe into the forgery claims.

“The respondent wishes to confirm to the court that the substrum of this suit being the 14 June 2022 from which review is sought is hereby withdrawn pending further investigations by the respondents -CUE which investigations are ongoing,” read court papers.

Sakaja asks court to jail CUE boss

Sajaka, who is seeking the Nairobi governor seat on a United Democratic Alliance (UDA) party ticket, asked the court to jail Prof Chacha for six months for contempt.

“We urge this court to be pleased to order the immediate arrest of Prof.Chacha Nyaigoti-Chacha. He should be presented in court and adjudged guilty for contempt of court, for breach of orders of the Honorable Court issued on June 15, 2022,” Mutuma said.

The candidate had used the degree certificate in question to get clearance to vie from the Independent Electoral and Boundaries Commission (IEBC).
