An investigating officer in a criminal case that flopped has been charged with giving wrongful testimony leading to the acquittal of an accused person before a court.
Reuben Tambaa was on Wednesday afternoon arraigned before a Kisumu court charged with perjury and obstruction.
The accused person appeared before the Kisumu’s Chief Magistrate court Teresa Odera.
He was charged with perjury, contrary to section 108(a) as read with section 110 of penal code, CAP 63 laws of Kenya.
The court heard that on the 20th day of September 2017 at Chief Magistrate courts in Kisumu East Sub-county in judicial proceedings, criminal suit no.542 of 2015 in which Vallery Jimoi was the accused person the said officer gave out a false testimony.
“While on a sworn oath before Hon. M Agutu, Tambaa knowingly gave false testimony touching on a matter which was material to a suit pending in a proceeding. You lied that you requested original title deeds from Rodolf George but he told you that they were held in Germany in the custody of a bank something you knew was not true,” the charge sheet read in part.
In count two, he was charged with obstruction of justice contrary to section 117(c) of the penal code, CAP 63 laws of Kenya.
The court was told that on the various dates between 2014 and 2017 while in Kisumu East as the investigative officer in the criminal case CR.627/67/2014 and CF 542/2015 the accused knowingly obstructed justice by failing to collect and present enough evidence.
As a result, it led to the acquittal of one Vallery Jimoi under section 210 of the criminal procedure code.
He was however released on a cash bail of Ksh 30,000.
The matter will come up for mentioning on May 20.
