In a five-hour judgement, Anti-Corruption Chief Magistrate Lawrence found former IEBC officials namely Kennedy Gaunye Ochae, Gabriel Ngonyo Mutunga and Willie Gachanja Kamanga guilty of altering tender documents submitted by Solarmak technologies limited for the supply of solar lanterns for use during the 2013 general election.
At the same time, the court convicted Benson Gethi Wangui and Joyce Makena who are the directors of Solarmak technologies, the company at the centre of the electoral fraud.
Gethi and Makena were convicted for the offences of forging a tax compliance certificate issued by the Assistant Commissioner of the domestic tax department at KRA.
Gethi is also a prime suspect in NYS season 1 scandal.
While convicting the IEBC officials, Mugambi said they hatched a plot to alter the tender documents for selfish gains leading to the loss of millions of shillings after they doctored a Ksh105 million tender to read Ksh147 million.
“Mutunga who was the procurement officer was the mastermind of the lethal scheme which gave rise to the loss,” Mugambi ruled.
He further castigated Mutunga for incorporating in his evil scheme a newly employed Ochae into signing the doctored tender documents way after the initial opening of tender documents.
The, however, magistrate acquitted former IEBC clerks Adan Katello Adano and Abdi Elena Ali all the graft charges for lack of evidence.
The five will be sentenced tomorrow.
