Six police officers who were charged with the murder of 2 Embu brothers have plead with the court to release them on bail pending trial.
Benson Njiru,22 and Emmanuel Mutura were found dead at Embu Level Five Teaching and Referral Hospital Mortuary.
The six officers; Benson Mputhia, Consolata Kariuki, Nicholas Cheruiyot, Martin Wanyama, Lilian Chemuna and James Mwaniki through an application filed in court claim that it is their constitutional right to bond/bail pending trial.
“That the accused persons has a constitutional right to fair trial which right entails the right to be presumed innocent until proven guilty. The detention of an accused where there is no compelling reasons is a violation of aforesaid right,” the court application read in part.
Through their lawyer Danstan Omari they argue that they are Kenyan citizens serving as police officers since the year 1992 who had been deployed to Manyatta police station in Embu before their incarceration .
The lawyer claim the accused persons turned up when the investigators required them to assist in investigations and have remained in custody since August 17,2021.
Omari claims investigations have been concluded hence the officers cannot interfere with evidence.
“Neither the victims, witnesses or investigators have opened up to having been threatened or unduly influenced by the accused persons with a view of interfering with investigations and the conduct of the case,” part of the application by the police officers read in part.
The six officers say they are ready and willing to adhere to the honourable court bail and bond terms and will attend court without fail.
The application is set to be heard on September 22,2021.
