Mpeketoni man rapes his daughter, infects her with HIV after enticing her with Ksh50

A 14-year-old minor yesterday narrated to a Mpeketoni court how her biological father repeatedly defiled her and infected her with HIV.

The minor who was testifying against her father before Mpeketoni Resident Magistrate Pascal Nabwana, informed the court that her father on the alleged day had enticed her with ksh50 to buy lunch.

“On the said day, my father came home in the morning and gave me ksh50. He then sneaked inside our bedroom in my grandmother’s house at night and whispered unakumbuka ile shilingi hamsini nilikupea? The ksh50 he had offered me was to entice me for sex,” she told the court.

The minor further revealed that after the act, her father left through the same hole and went back the following night and forced himself to her.

She told the court that it had become a routine for her father to defile her whenever he wanted.

“I was in pain but there was no one l could turn to. l knew my grandmother wouldn’t believe me since l knew of a case where my uncle had defiled a minor in the vicinity, and she always defended her sons. l did not know what to do. l woke up the following morning too confused, took a bath and in a lot of pain and tears went to school,” she said.

The minor further informed the court that her father attempted to defile her 16-year-old sister too but she managed to escape.

“I shared my ordeal with my aunty who took me to hospital for medical tests. I was later informed l had been infected with HIV,” she explained to the court.

The father in question has since denied four counts among them, committing an indecent act with a child contrary to section 11(1) of the Sexual Offences Act, attempted defilement, deliberate transmission of HIV contrary to section 26(1)a of the Sexual Offences Act no 3 of 2006, and incest contrary to section 20(1) of the Sexual Offences Act no 3 of 2006.

The case will be heard on August 25, 2021.
