Ex-Tetu MP charged with creating disturbance at Sh20bn estate he co-owns with his brother

Former Tetu MP James Ndung’u has been charged with creating a disturbance at a multibillion shillings estate in Kitusuru over an incident that happened last year.

The charging comes after a failed attempt to settle the dispute out of court.

The former MP was charged alongside Josiah Otimu, Godfrey Ochieng, Kennedy Asewe and Ouma Ogonji.

They appeared before Nairobi Magistrate Bernard Ochoi on Wednesday, November 11, where they denied the charge.

The prosecutor told the court that the suspects broke the door of a server room and chased away Wells Fargo security guards who were manning Kihingo Village Waridi Gardens in Kitusuru, a property the ex-MP was engaged in a dispute with his brother and other shareholders.

The incident, according to the prosecutor, occurred on October 16, 2019.

The former MP’s brother, Gitahi Gethenji, is the complainant in the case.

The prosecution counsel, James Gachoka, said Gethenji had written a letter to the office of the Director of Public Prosecutions wanting to withdraw the case but later abandoned the plea leaving the ODPP with no choice but to prosecute the case.  

The magistrate released the accused persons on a cash bail of Sh10,000 each with the case slated for mention on November 26.

The former MP and his brother are main shareholders of the multi-billion Kihigo Village (Waridi Gardens) which straddle acres of land in the post neighbourhood.

The two have been fighting over the management of the estate valued at over Sh20 billion.

Waridi Gardens Estate in Kitisuru consists of 55 housing units each valued at Sh400 million and a Club House.
