Businessman Chris Obure has moved to the High Court seeking to quash the decision by the Director of Public Prosecutions Noordin Haji to charge him with the murder of Kevin Omwenga by one of his close associates.
Chris, through his lawyer Danstan Omari, said his fundamental rights have been infringed upon by the intended prosecution that he termed malicious, scandalous, unlawful and unconstitutional.
The businessman, in a sworn affidavit, said that the had no direct or indirect link to the murder of Kevin Omwenga.
He told the court that he learnt of the death of the said Omwenga and the involvement of his bodyguard only recently.
Further, Obure said that Directorate of Criminal Investigations officers retrieved footage from his office that showed Robert Ouko Bodo, the murder suspect, breaking into his office and stealing his gun.
High Court judge Mumbi Ngugi deferred the plea taking to Wednesday, September 9, 2020, to allow Obure to argue his application challenging the murder charge.
Obure’s lawyer said that his client wants to be a state witness.
