The lawyer of Malindi Member of Parliament Aisha Jumwa claims that the legislator, who has been implicated in misappropriation of Ksh19 million CDF kitty, could not appear in court on Friday, August 28, alongside her six co-accused because she is “ailing”.

Danstan Omari, who represents Jumwa, told Mombasa Law Courts Chief Magistrate Edna Nyaloti that Jumwa is “receiving treatment in a county which is far away from Mombasa”.

Magistrate Nyaloti ordered that the MP appears physically in court on Monday, August 31.

“I hope she will be in good health by then so that she can take plea,” said Omari.

The parliamentarian is accused of pocketing Ksh2.5 million, which she “irregularly” received from a company said to have unlawfully obtained Ksh19 million from the Malindi CDF kitty.

The Director of Public Prosecutions (DPP) on Thursday, August 27 ordered the arrest of Jumwa, four Malindi CDF committee members, CDF account manager and a director of a company that allegedly irregularly received Ksh19 million after a flawed tendering process.

The firm, Multserve Contractors Limited, which is allegedly linked to Jumwa, was tasked with building the Malindi Sub-County Education Office.

Minus Jumwa, the other six accused persons were arraigned before Chief Magistrate Nyaloti on Friday.

All of them pleaded not guilty to charges of conspiring to commit graft and money laundering, and were released on a Ksh10 million bond or Ksh5 million cash bail each.
