IG Kanja ordered to disclose whereabouts of missing Wajir MCA within 14 days

Milimani High Court Judge Chacha Mwita has ordered the Inspector General of Police Douglas Kanja to reveal the whereabouts of the missing Wajir Member of County Assembly (MCA) Yussuf Hussein Ahmed within 14 days.

Giving the directive through a virtual court proceeding on Wednesday, January 22, 2025, Justice Mwita noted that earlier there was an order for the Inspector General of Police to disclose the whereabouts of MCA Yussuf or produce his body in court.

However, Judge Mwita said that the Inspector General of Police and Directorate of Criminal Investigations did not abide by the directions ordered by the court on September 18, 2024.

“In the meantime, an order is hereby issued directing the Inspector General of Police to within 14 days disclose the whereabouts of third petitioner Yussuf Hussein Ahmed,” Judge Mwita directed.

The court had been urged to grant the orders in an application dated November 8, 2024, that included an order directing the Inspector General of Police to disclose the whereabouts of the missing Wajir MCA.

In this case, the Law Society of Kenya (LSK), Wajir County Governor Ahmed Abdullahi and the missing MCA are listed as the first, second and third petitioners respectively.

The Inspector General of Police (IG), the Directorate of Criminal Investigation (DCI), the Director of Public Prosecutions (DPP) and the Attorney General (AG) are the respondents in the case while the Independent Police Oversight Authority (IPOA) is an interested party.

Written submissions

Mwita also directed the petitioner to serve written submissions to the petition not exceeding 10 pages within 7 days from the date the orders were issued.

He also added that the respondents and interested parties will have 7 days after service to file their written submissions not exceeding 10 pages each.

Notably, Justice Mwita added that he will not be extending the duration for the Inspector General of Police and the Directorate of Criminal Investigations to file the submissions on the matter.

Mwita added that the written and served submissions will be highlighted on April 9, 2025.

The Dela Ward MCA was reported missing on September 13, 2024, following a report that he was abducted along Enterprise Road in Nairobi’s Industrial Area.

Later, after he went missing, a body was recovered in Lake Yahud and believed to be his but later proved it was not him after two DNA tests done turned negative.
