Man sentenced to 10 years in prison for rape

Nakuru Resident Magistrate Edward Oboge has sentenced a man to 10 years in prison for the offence of rape.

Office of the Director of Public Prosecutions (ODPP) in a statement shared on Wednesday, December 18, 2024, said that Duke Obdiek Ombati was slapped with the sentence after he was found guilty of rape, contrary to Section 3 (1) (a) (b), as read with subsection 3 of the Sexual Offences Act.

“Nakuru Resident Magistrate Hon. Oboge has sentenced Duke Obdiek Ombati to 10 years in prison after he was found guilty of rape, contrary to Section 3 (1) (a) (b), as read with subsection 3 of the Sexual Offences Act. The accused was convicted under Section 215 of the Criminal Procedure Code,” ODPP said in the statement.

The convict is said to have committed the incident on September 24, 2024, in the Pinewood area of Nakuru East Sub-County, Nakuru County.

How rape victim was lured

According to the ODPP, the convict lured the victim to his apartment after he came across her while in the course of her business.

The victim accompanied the accused to his house only for him to lock the door and commit the heinous act after he overpowered her.

“The incident occurred on the 24th of September, 2024, in the Pinewood area of Nakuru East Sub-County, Nakuru County. The victim was hawking fruits when the accused lured her into his apartment by claiming that he had children in the house who needed fruits.

“She accompanied him to the house. Upon arrival, the victim realized there were no children, and when she inquired, the accused admitted it was a trick to get her to the house. He then locked the door. The victim attempted to escape, but the accused overpowered her, stripped her clothes, and committed the heinous act,” the ODPP stated.

Oboge while delivering his verdict concluded that there was sufficient evidence, including the identification of the accused, lack of the victim’s consent, and proof of the criminal act.

Five witnesses were presented in court and ultimately proved the case beyond a reasonable doubt.
