A magistrate at the Makadara Law Courts in Nairobi was on Thursday, June 13, 204, wounded after being shot by a police officer.
Magistrate Monica Kivuti was shot in the hip after she cancelled the bond of an accused person, who is the wife of the police officer, on grounds that she had jumped bond and failed to offer a satisfactory explanation.
“During an open court session earlier today, the Magistrate cancelled the bond for an accused person who had jumped bond and had failed to offer satisfactory explanations for jumping bond. Immediately this decision was pronounced, a person shot at the Magistrate and injured her on the hip,” Winfridah Mokaya, the Chief Registrar of the Judiciary said in a statement.
Neutralised
The officer was, however, shot dead by his colleagues at the court while Magistrate Kivuti survived the ordeal and was rushed to hospital.
“She was rushed to the hospital where she is receiving treatment… it is an unfortunate incident since magistrates are never offered security, ” the magistrate’s friend who spoke on condition of anonymity told K24 Digital.
Senior police officer
According to a police report filed at Jogoo Road Police Station, the officer in the shooting incident has been identified as 55-year-old Samson Kipchirchir Kipruto, who served as an OCS at Londiani.
The OB report states that the officer’s wife namely Jenniffer Wairimu aged 48 years was an accused person in a case of obtaining money by false pretence, amounting to Ksh2.9 million.
“The same occurred today 13/06/2024 at 13.45 hrs within Makadara law courts Map reference 573615 about 1km southwest of the station and reported vide ob no. 45/13/6/2024 at 1450hrs by the OC Law courts that a presiding magistrate P.M Kivuti had been shot on the left hip.
“The OCS Jogoo and team rushed to the scene and established that it was alleged that a police officer identified as no. 235435 C.I Samson Kipchirchir Kipruto OCS Londiani aged 55 years whose wife one Jenniffer Wairimu 48 years was an accused in a case of obtaining money by false pretense amounting to Ksh2.9 million, his wife had pleaded to be released out on cash bail but the court did not grant,” the OB at Jogoo Road Police Station reads in verbatim.
Mode of entry
Police say the neutralised officer entered the court through the magistrates door and fired shots towards the magistrate, injuring her on the chest and left hip.
“He entered inside the court through the magistrates door and fired shots towards the magistrate injuring her on the chest and left hip. He was countered and fatally shot by a fellow officer who was in the court,” the police say in the OB report.
Three police officers were also injured in the melee. A Jericho pistol was recovered at the scene of the incident.
