Thursday, October 10, will be a public holiday, the State confirmed on Tuesday, October 8.

October 10, previously known as Moi Day, continues to be a public holiday until the day the National Assembly follows due process in scrapping it off, Justice George Odunga ruled in November 2017.

The judge said the State’s move to omit Moi Day as a public holiday contravened the Public Holidays Act.

“Unless Parliament amends Schedule 1 of the Public Holidays Act or the minister substitutes the same for another date, October 10 in each year shall continue being a public holiday, ” Justice Odunga ruled on November 8, 2017.

And now, given Parliament is yet to make any amendments to the Public Holidays Act, October 10, just like it was in 2018, will, in 2019, be set aside for the public to rest.

In a statement issued on Tuesday, October 8, Interior minister, Dr Fred Matiang’I, said: “In line with the provisions of the Public Holidays Act (Cap 110, Laws of Kenya) and the decision of the court in Judicial Review No. 292 of 2017 (Republic v Cabinet Secretary for Internal Security Ex Parte G O Nyauchi & 4 Others) it is hereby confirmed that 10th October 2019 will be a public holiday.”

Matiang’i urged Kenyans celebrate October 10 “with selfless acts of service to their community that seek to promote patriotism, national unity, social justice, cohesion and sustainable development in their communities for the benefit of present and future generations.”
