PSC hits back at CJ Maraga, moves to High Court to contest dissolution advisory

Parliamentary Service Commission (PSC) has hit back at Chief Justice (CJ) David Maraga for advising President Uhuru Kenyatta to dissolve Parliament.

Led by their chairman, National Assembly Speaker Justin Muturi, PSC said CJ Maraga’s call is pre-mature and could plunge the country into a constitutional crisis.

On Monday, Maraga dropped a bombshell when he urged President Kenyatta to dissolve the House because of its failure to enact legislation on two-thirds gender rule.

But PSC has responded by moving to the High Court to challenge the call to dissolve Parliament.

“The Commission notes with disappointment that the Chief Justice has ignored fundamental issues that go to the root of the fabric and structure of our Constitution in advising the President to dissolve Parliament,” said Speaker Muturi.

Further, Muturi accused Maraga of ignoring two High Court petitions set for hearing on October 7, 2020, over the applicability of an order made in 2017 by Justice John Mativo on the issue.
