Two people, a man and a woman, have been charged before a Kisumu court for making forged documents with an aim of obtaining a bank loan through impersonation.
The two, Churchill Otieno and Beatrice Deya, appeared before Winam law courts Senior Principal magistrates Hezron Nyaberi.
They were charged with making false documents contrary to section 347 (d) (i) of the penal code. The court heard that on November 25, 2020 at Momentum credit offices in Kisumu, the duo unlawfully signed a loan application form of Ksh550,000 in the name of one Jack Omolo without his authority.
The duo however pleaded not guilty to the charge and requested the court to release them on bond.
On her side, Deya requested the court to release her on reasonable bond terms. She said that she is a widow with two children and thus not a flight risk.
“I am a widow and the bread winner in my family. I plead with the court to release me on a reasonable bond terms with an alternative cash bail,”she said.
She added that she has always cooperated with the police and responded everytime she is called upon by the investigative officers.
Otieno also pleaded with the court to release him on reasonable bond terms.
After considering the applications made by the two in court, the magistrate ruled that they be released on Ksh100,000 bond with alternative cash bail of Ksh20,000 each.
The presiding judge said that the duo should be supplied with court statements while in remand at the Kondele police station awaiting full payment of their respective bonds.
