Narok Senator Ledama ole Kina yesterday got a reprieve after the High Court barred the Senate from effecting his removal as chair of the County Public Accounts and Investments Committee (CPAIC).

Justice Weldon Korir issued the temporary orders after Kina filed a petition protesting his removal by his ODM party, arguing that he was validly elected to the position.

“I find that the petitioner has established an arguable case. His pleadings show that unless conservatory orders are issued the petition may be overtaken by events,” said Justice Korir.

Through lawyer Nelson Havi, the senator accuses the Senate Speaker and the Leader of Minority of purporting to remove him from membership of the Senate Business Committee and chairperson of CPAIC without notice and without according him a hearing as required by Standing Orders.

“I am not guilty of any misconduct to warrant being de-whipped,” he states in court documents. The matter will be mentioned on Thursday.
