An attempt by Thirdway Alliance Party leader Ekuro Aukot to stop the Building Bridges Initiative has failed.
This is after the High Court on Wednesday dismissed Dr. Aukot’s application seeking to declare the BBI taskforce illegal.
In his ruling on Wednesday, Justice John Mativo said that the President was within his rights to form the BBI team, and that the taskforce passed the legality test.
Aukot had faulted the appointment of the task force members, arguing that they had not been vetted, therefore, the task force was illegally constituted.
“I note that the gazette notice factored in public participation and in saying that everything that the President does must be subjected to public participation will be unnecessary constraining his constitutional functions,” said Justice Mativo.
“There is nothing before me to show that the President acted in bad faith,” he added.
Further, the judge said that the court can not entertain such an application.
Justice Mativo also ruled that the issue of funding the BBI team falls within the purview of the Auditor-General and that Dr. Aukot did not provide evidence to prove that the team has misused public funds.
