Blow to Waiguru as judge rules in favour of MCAs who impeached her

Embattled Governor Anne Waiguru has been dealt a huge blow by the High Court after it ruled that Kirinyaga ward representatives were within their rights to impeach her.

Governor Waiguru had on Wednesday, June 10, moved to court to file a contempt case against the MCAs who voted for her removal.

But Justice Weldon Korir on Thursday, June 11, ruled that the MCAs did not violate any court order when they voted to impeach Waiguru on June 9.

He dismissed Waiguru’s application, ruling that the respondents proved their case that they did not violate any court order.

In an amended petition, Waiguru had asked the court to suspend any resolution passed or made with regard to her impeachment.

She also wanted the court to declare that proceedings commenced by the Kirinyaga County Assembly while ignoring the April 7 temporary reprieve order by Justice Korir as null and void.

It was Justice Korir who in April stopped her impeachment on grounds that the current Covid-19 pandemic would violate her constitutional right to a fair hearing since her energies needed to be focused on containing virus.
