Awendo MP John Walter Owino’s wife and firm have suffered a big blow after High Court declined to issue conservatory orders to stop imminent arrest and prosecution over Sh84 million tax evasion allegation.   

Justice James Makau declined to grant the orders and ordered the MP, his wife Beatrice Mboya and their company Gillys Security and Investigations Services Ltd serve the Kenya Revenue Authority and Director of Public Prosecutions wit their application before inter parties hearing on Wednesday.

The couple and the firm, through lawyer James Orengo, sought orders to bar authorities from arresting and prosecuting them over the tax evasion allegation.

“Gillys Security and Investigations Services Ltd and Mboya are living in apprehension of imminent arrest, charge and prosecution by DPP based on the unverified and premature tax claims against them by KRA,” Mboya said.

Further, she sought conservatory orders, claiming that KRA’s had turned the tax dispute into a criminal issue.

 They accused KRA of refusing and neglecting to follow the statutory procedure of settling tax disputes.
